How difficult is it to break a non compete?

I have worked as a physician recruiter for the past 1 and some change. I enjoyed my profession, but I grew unhappy with the company I was working for. More than that, I wanted to relocate about 150 miles away to be with my girlfriend and closer to my family. I was aware that I had signed a non-compete as a condition of employment with my previous employer. However, I would be eligible to be employed with a competitor if given permission. Also, my previous employer has allowed others in the past to be released from their non-compete. So, I have interviewed and received job offers from 2 firms. I approached my previous employer to ask permission and was denied. The conditions of my non-compete are that I not work within a 300 mile radius for 24 months. I can probably find another job, but I enjoyed what I did. Not to mention, I do not have a degree and may not be able to secure an opportunity that comes close to providing the type of income I am accustomed to. Do I have any rights?

What state are you in? Different states have different attitudes towards non-compete agreements.

In general, 24 months and 300 miles would be acceptable to a court, but some states would consider it too broad.
